Checklist B – Agreements with other educational institutions

For a contract to be reviewed, please confirm the following points are covered in the contract.

For a contract to be drafted, please advise the following points by typing underneath each point.

    • The party which will award the qualification (Unitec OR the other party OR a joint award?)
    • The party with the responsibility for obtaining / maintaining approval of the programme (This question may not be appropriate if dealing with an overseas institution)
    • The party with the responsibility for obtaining / maintaining NZQA accreditation for delivery of the programme (This question might not be appropriate if dealing with an overseas institution)
    • The party which owns the IP in the programme (And whether this will also apply to any new IP developed under the contract)
    • Whether the programme (and the IP in it) is to be licensed or sold (By whom, to whom, and when?)
    • The party which will enrol the students and receive the EFTS or other funding, if any
    • The party which will deliver the programme
    •  Where the programme will be delivered
    • Which party will provide quality control, if any (And, if so, how this will be carried out. For example, do the other party’s teachers need to have attained a particular level of qualification or number of years of experience?)
    •  Whether there are any minimum requirements for Unitec to enter into the agreement (E.g. minimum student numbers, minimum staff numbers, minimum support standards, minimum equipment requirements. These may be needed more for agreements with overseas institutions, i.e. where we cannot rely on NZQA accreditation to ensure quality)
    • Which party will be responsible for marketing the programme, and what this will involve (If this will be undertaken by the other party, do we need to approve their advertising and the way our name and logo is to be used?)
    • How the programme will be branded (E.g. as a Unitec programme, OR as a programme of the other party, OR joint branding)

 

  • Whether any establishment fee will be payable to cover set-up expenses
